Reconsideration of a Social Security Denial

The Next Step

If your initial application for Social Security Disability (SSD) or Supplemental Security Income (SSI) has been denied, you are not alone. The Social Security Administration (SSA) denies more than 70 percent of all initial applications.

The denial of your initial application is not the end. We can still help you obtain the benefits you need.

Fortunately, there is a review and appeal process in place. The SSA will still extend benefits to claimants whose initial claims were denied in many cases. At Midwest Disability, P.A., we have more than 50 years of experience with SSD/SSI claims. From our office locations in the Midwest, our Social Security Disability attorneys represent clients throughout the U.S. No matter where you live, we will help you through the complicated Social Security process.

How to Appeal a Disability Denial | Reconsideration of a Social Security Denial

After receiving a notice of denial, the first essential step is to petition for reconsideration.

The request for reconsideration must be filed with the Social Security Administration (SSA) within 60 days of receiving your notice of denial of your initial application. The reconsideration phase looks a lot like the initial application stage. In most cases, a new claims examiner will review your case on reconsideration, looking over the same documentation, as well as:

  • Any additional information: This is the opportunity to provide any new medical information that has come up since filing the initial application or provide information that was left out the first time.
  • Explanation of why you don’t agree with the denial: You will have the opportunity to explain why the denial was unfounded, and why you should indeed receive the benefits you are claiming.
  • Medical records: Again you will need to file all of the appropriate medical documentation for the SSA to review.

We have extensive experience and expertise with the petition for reconsideration. With more than 50 years of experience, our lawyers understand the difficulties and stress involved with being too injured or ill to work. We will help you every step of the way.
